Welcome to USA Card Show ("we," "us," or "our"), operating usacardshow.com (the "Site") and hosting card shows nationwide. These Terms of Service ("Terms") govern your access to and use of the Site, event tickets, vendor applications, and related services. By using our Site, purchasing tickets, or attending events, you agree to these Terms. If you do not agree, we kindly ask that you refrain from using our Site or services. These Terms constitute a legally binding agreement. We reserve the right to modify them at any time—continued use following changes constitutes acceptance. Please review periodically.
1. Services Offered
We offer comprehensive information about our nationwide card shows, including online ticket sales, vendor booth applications, attendee registration, and detailed event schedules. All events take place at venues listed on the Site. Unless explicitly stated otherwise, all sales are final.
2. User Eligibility & Accounts
You must be at least 18 years old or have parental/guardian permission to use our services. All registration information must be accurate and current. You are responsible for maintaining the confidentiality of your account credentials. We reserve the right to suspend or terminate accounts for any violations of these Terms.
3. Tickets & Purchases
- All tickets are non-refundable and non-transferable except as specifically noted.
- Show entry is not guaranteed—tickets may sell out or shows may be canceled due to force majeure events (weather, acts of God, etc.).
- Prices exclude applicable taxes and fees; all sales are final within 24 hours of purchase.
- Lost or stolen tickets will not be replaced or refunded.
4. Vendor Terms
All vendors must complete and be approved through our application process. Only authentic trading cards and permitted merchandise may be sold—no counterfeits, prohibited goods (weapons, drugs, illegal substances, etc.). We reserve the right to remove any vendor without refund for violations. Table assignments are at our sole discretion with no guarantees regarding location or traffic.
5. Event Rules & Code of Conduct
- No smoking or vaping permitted indoors; all venue rules must be followed.
- Treat staff, vendors, and fellow attendees with respect—no harassment, theft, or disruptive behavior.
- Children under 12 admitted free with paying adult; adult supervision required at all times.
- Outside food and beverages prohibited unless specifically permitted.
- Violations will result in immediate removal from the show without refund.
5.1 Media Consent & Notice of Filming/Photography
- By visiting our Site, purchasing tickets, or attending USA Card Show events, you consent to photography, audio, and video recording.
- Your presence grants USA Card Show a royalty-free, worldwide, perpetual license to capture and use your image, voice, and likeness for promotional purposes—including our website, social media, advertising, and event marketing without compensation, inspection, or prior approval.
- This covers individual shots and crowd footage. You waive all related claims for privacy, right of publicity, defamation, or compensation.
- If you do not consent, please do not use our Site, purchase tickets, or enter events. On-site attendees may notify staff to avoid photo areas when feasible.
6. Prohibited Conduct
You agree not to: post illegal content, harass others, reverse-engineer our Site, use automated tools or bots, or violate any applicable laws. Specifically prohibited: trading counterfeit cards, selling altered or tampered items, or engaging in scams.
7. Intellectual Property
All Site content, including logos, images, and materials, is owned by us or our licensors and may only be used for personal, non-commercial purposes. Commercial reproduction requires written permission.
8. Disclaimers & Liability Limitations
Our services are offered "AS IS" with no warranties, express or implied. We do not guarantee the quality, authenticity, or condition of products sold by independent vendors—purchases from vendors are at your own discretion. We shall not be liable for show cancellations, personal injuries (except where caused by our gross negligence), or any indirect, consequential, incidental, or punitive damages. In no event shall our total liability exceed the amount you paid for your ticket.
9. Indemnification
You agree to indemnify, defend, and hold harmless us, our affiliates, officers, directors, employees, agents, staff, partners, sponsors, and each of their respective successors and assigns from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from your use of our services, violations of these Terms, or your activities as a vendor.
10. Termination
We reserve the right to terminate your access to our services at any time, for any reason, with or without notice.
11. Governing Law & Dispute Resolution
These Terms and any disputes are governed by the laws of the State of California, without regard to conflict of laws principles. Any disputes will be resolved through binding arbitration in Orange County, California under American Arbitration Association (AAA) rules. No class actions permitted. Small claims court remains an option.
12. Force Majeure
We are not liable for any delays, cancellations, or failures to perform due to unforeseen circumstances beyond our reasonable control.
13. Miscellaneous
No waiver of any provision is effective unless in writing. If any provision is found invalid, the remaining provisions remain enforceable. These Terms constitute the complete and exclusive agreement between us, superseding any prior agreements or understandings.
14. Electronic Communications
You consent to receive communications from us electronically (email, Site notices, Eventbrite/Ticket Tailor confirmations). You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement for written communication.
15. Third-Party Links & Services
We partner with Eventbrite, Ticket Tailor, and Cognito Forms to handle ticketing, registrations, and vendor applications seamlessly. Please note that we are not responsible for their content, privacy practices, fees, refund policies, or service availability.
When you purchase tickets, submit registrations, or use forms through these platforms, their respective terms of service govern your transaction—which you agree to by completing your purchase or submission.
Any other third-party links on our Site are provided purely for your convenience. Your use of external sites and services is entirely at your own discretion.
16. Export Controls
You agree to comply with all applicable U.S. export control laws and regulations. No services, content, or event access may be provided to prohibited persons or destinations in violation of these laws.
